Manifestation Determination
Manifestation Determination is a designated process that is used to determine if a students' action was a result of his or her disability. This is a review process that occurs within 10 days of a students' serious disciplinary incident.
During Manifestation Determination, the school, parents, and IEP team join together to discuss the process. The ultimate goal of Manifestation Determination is to determine if a specific inappropriate behavior is related to the student's disability or if it is the school's inability to effectively implement the IEP or neither. The foundation of this process stands on the idea that a student should not be punished for behaviors that are directly related to their disability because it is uncontrollable.
During the process, the situation is reviewed very carefully. Before, during, and after the incident occurred is examined in addition to other observations and facts. All of this information is brought together to determine if the specific behavior is related to a student's disability. If it is concluded this is the case, then the student is not held responsible and is allowed to return to their class. However, if the behavior is decided to not be related to a disability, then the regular disciplinary process takes place. If the behavior is due to a lack of implementation of an IEP, the school must take drastic measures to ensure that a situation like that does not happen again.
